1. Acceptance of Terms

By accessing or using the services provided by Kinwell, LLC ("Kinwell," "we," "us," or "our"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services.

2. Description of Services

Kinwell provides assistance with applications for Michigan's Home Help Program, a Medicaid-funded program that allows eligible individuals to receive in-home care from a caregiver.

Kinwell is not a government agency and does not determine eligibility or approve applications. All eligibility decisions are made by the Michigan Department of Health and Human Services (MDHHS).

3. Eligibility

Our services are intended for caregivers or prospective caregivers of individuals enrolled in or eligible for Michigan Medicaid. By using our services, you represent that all information you provide is accurate, complete, and truthful.

4. User Responsibilities

You agree to:

• Provide accurate and complete information
• Not submit false or fraudulent information
• Use the services only for lawful purposes

You are responsible for maintaining the confidentiality of any account information associated with your use of the services.

5. Authorization

By submitting your information through Kinwell, you authorize us to:

• Review your information to assess eligibility
• Prepare and submit a Michigan Home Help application on your behalf
• Act as the patient's authorized representative solely for the purpose of completing and submitting the application
• Communicate with the Michigan Department of Health and Human Services and local county offices regarding the application, including coordinating any required in-home assessments

You also authorize Kinwell to access and review information necessary to complete the application, including relevant medical or health information required for eligibility determination. If you are submitting information on behalf of another individual, you represent that you are the patient or have the legal authority to provide this authorization.

6. No Guarantee

Kinwell does not guarantee approval of any application. Eligibility determinations are made solely by the Michigan Department of Health and Human Services. Kinwell provides application assistance only.

7. Limitation of Liability

To the fullest extent permitted by law, Kinwell shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services. Our total liability shall not exceed any amount paid, if any, for use of our services.

8. Intellectual Property

All content, trademarks, and materials on this website are the property of Kinwell, LLC and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written consent.

9. Modifications

Kinwell may update these Terms & Conditions at any time. Changes are effective upon posting. Continued use of the services constitutes acceptance of the updated Terms.

10. Governing Law

These Terms & Conditions are governed by the laws of the State of Delaware, without regard to conflict of law principles.
